These Terms & Conditions explain the rules for using Kidzamania.com. Kidzamania is an online directory that helps families discover kids classes, camps, activities, events, attractions, online programs and other services offered by independent providers.

1. Using Kidzamania

By accessing or using Kidzamania.com (the “Site”), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Site.

You do not need a provider account to browse public listings. Provider accounts are for adults age 18 or older who are able to enter into a binding agreement.

2. What Kidzamania does

Kidzamania is a directory and discovery service. We do not teach the classes, run the camps or events, provide the listed services, or employ the providers shown on the Site.

Providers are independent third parties. Their own terms, privacy policies, cancellation rules, refund policies and other conditions may apply.

3. Provider accounts

To create and manage activity listings, a provider must create an account, verify the account email and complete the required Provider Profile information. You agree to provide accurate, current information and to keep it updated.

You are responsible for keeping your password and account secure and for activity that takes place through your account. Please contact us promptly at info@kidzamania.com if you believe your account has been used without permission.

4. Activity listings and provider content

Providers are responsible for the accuracy, legality and completeness of the information they submit, including descriptions, schedules, prices, locations, registration links, photos, logos and contact information.

By submitting content to Kidzamania, you confirm that you own it or have permission to use it and to allow Kidzamania to display and promote it. This includes having any permissions that may be required for photographs or other content featuring children or other people.

You keep ownership of your content. You give Kidzamania a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, format, display, distribute and promote that content as reasonably needed to operate and promote Kidzamania, including on Kidzamania pages, search results, emails and social media.

We may make technical or formatting changes to improve how content appears on different devices. Providers remain responsible for the underlying accuracy of their information.

5. Review and publication of listings

New provider activities may move through statuses such as Draft, Pending Review, Published and Archived. Submitting an activity does not guarantee that it will be published.

We may review a listing, ask for changes, approve it, reject it, unpublish it or archive it. We may also remove content that is inaccurate, outdated, inappropriate, infringes someone’s rights, violates these Terms, or is otherwise not suitable for the Site.

Our review is for Site quality and administration. It does not mean that Kidzamania guarantees a provider, activity, business, instructor, location, license, insurance, background check, safety standard or service quality.

If a “Verified provider” label or similar label appears, it means only that Kidzamania has applied its own administrative verification process. It is not an endorsement or guarantee of the provider or its services.

6. Responsibilities of providers

Providers agree to:

• publish truthful and current information;
• keep schedules, prices, availability and registration links reasonably up to date;
• comply with laws and rules that apply to their business and activities;
• have the rights and permissions needed for all text, photos, logos and other material they upload;
• not upload unlawful, misleading, harmful, discriminatory, infringing or deceptive content; and
• handle registrations, payments, refunds, cancellations, safety matters and customer service for their own activities.

7. Families and visitors

Information on Kidzamania is provided to help families discover possible activities. Before registering or paying, families should review the provider’s current information, policies and suitability for their needs.

Kidzamania cannot guarantee that a listing is complete, current, available, safe or appropriate for a particular child. You are responsible for deciding whether to contact, register with or purchase from a provider.

8. External websites and services

Listings may link to provider websites, registration systems, social media pages and other third-party services. Kidzamania does not control those sites and is not responsible for their content, availability, security, privacy practices or transactions.

9. Email and other communications

We may send providers account and service messages that are necessary to operate Kidzamania, such as email verification, password resets, listing-review updates, publication notices, account notices and important service information.

If you choose to receive marketing communications, we may also send occasional Kidzamania news, provider tips, information about new services or features, events and promotional opportunities. You can unsubscribe from marketing emails at any time. Unsubscribing from marketing does not stop necessary account or service messages.

10. Intellectual property

Except for content submitted by providers or other third parties, the Site’s design, branding, software, original text, graphics and other original Kidzamania material are owned by or licensed to Kidzamania and are protected by applicable intellectual-property laws.

You may use the Site for normal personal or business use related to discovering or listing activities. You may not copy, scrape, republish, sell or exploit substantial parts of the Site or its data without permission, except as allowed by law.

11. Prohibited use

You may not use Kidzamania to break the law, interfere with the Site, attempt unauthorized access, distribute malware, impersonate another person or business, submit fraudulent information, harvest user information, or misuse the Site in a way that harms Kidzamania, providers, families or other users.

12. Account suspension and removal

We may disable an account, hide provider activities, remove listings or restrict access if we reasonably believe these Terms have been violated, information is misleading or unsafe, the account creates security or legal risk, or action is needed to protect the Site or its users.

13. Disclaimer of warranties

To the fullest extent permitted by law, Kidzamania and the Site are provided “as is” and “as available.” We do not promise that the Site will always be available or error-free, or that provider information will always be complete, accurate or current.

Kidzamania does not make warranties about independent providers or the activities, services, products, locations or websites they offer.

14. Limitation of liability

To the fullest extent permitted by law, Kidzamania will not be responsible for indirect, incidental, special, consequential or punitive damages arising from use of the Site or dealings with a provider. Kidzamania is not responsible for injuries, losses, cancellations, refunds, payment disputes, service quality or other claims arising from an activity or transaction between a visitor and an independent provider.

Where liability cannot legally be excluded, Kidzamania’s total liability will be limited to the greater of $100 or the amount you paid directly to Kidzamania for the applicable service during the 12 months before the claim.

15. Provider responsibility for claims

To the extent permitted by law, providers are responsible for claims arising from their listings, content, business, activities, services, transactions or violation of these Terms, including claims that submitted content infringes another person’s rights.

16. Privacy

Our collection and use of personal information is described in the Kidzamania Privacy Policy.

17. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. If a change is important to provider accounts or services, we may also provide notice by email or through the Site.
